Terms of service
The short version: the site is informational, the work is governed by the contract we sign, and what you pay for becomes yours.

Using this site
The pages here describe what EVERCODE, LLC does. They are not an offer, a quotation or a warranty, and we may change them. The text, images and code on this site belong to EVERCODE, LLC unless stated otherwise.
Working with us
Every engagement runs on a written agreement that names the scope, the schedule and the price. Where that agreement and this page disagree, the agreement wins.
Rights in the work we deliver, source code, assets and documentation, transfer to you on full payment. Until then they are licensed to you for review and testing. Third-party components keep their own licences, and we list them.
Your accounts, signing keys and published applications remain yours throughout. We work with access you grant us and can withdraw at any time; withdrawing it ends our ability to publish, not your ownership of anything.
Each of us keeps the other's confidential material confidential, during the work and after it.
What we do not promise
Whether an application is accepted into the App Store or Google Play is decided by Apple and Google, not by us. We build to their rules, we answer reviewers and we ship the fixes a rejection asks for, but we cannot guarantee acceptance, a date of acceptance, a ranking, a download number or revenue. Anyone who guarantees those is guessing.
Store rules, platform APIs and device requirements change on the platform owners' schedule. Keeping an application current with them is maintenance work, and we price it as such.
Liability
Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Beyond that, our liability under an engagement is limited to the fees paid for it, and neither of us is liable to the other for indirect or consequential loss.
Law
These terms and any engagement are governed by the laws of Georgia, and the courts of Tbilisi have jurisdiction, unless the signed agreement names another.
